DECEASED ESTATES ADMINISTRATION
Deceased estates and their origin
Death comes to all humanity, and has ever since the beginning when its first parents transgressed God's Law. God's Law is love. Love requires trust. The human family, when they were put to the test, chose to "not love" their Creator. To love or to "not love" was the freedom of choice given them by their Creator. They chose to distrust the One who made them and they ate the forbidden fruit of the tree of the knowledge of good and evil (The Holy Bible, Genesis 3). Jesus meant for His creatures to know only good. By eating of the fruit of the tree of knowledge of good and evil, humanity made the choice to know evil, of which death is an evil which man has ever since come to know very intimately.
A fairytale is often told by many churches and religious sects teaching that loved ones are not really dead when they die. Instead of the truth, their fairytale propagates the lie that loved ones who die go to heaven or to hell-fire when they die. The Beast of Revelation - the Roman Catholic Church - whose "Mark" ("the Beast's Mark") you are not supposed to get, propagates the teaching that certain loved ones go to a place called purgatory - a place where loved ones burn a while for their sins. Each of these teachings is but a repetition of the lie told by the mighty fallen angel, Lucifer, or Satan as he is better known, namely his lie: "You won't really die." Genesis 3:4. The first recorded lie: 'You will die, but your won't really be dead.', that is, "You won't really die." This is the fairytale lie repeated by millions.
The truth is that when loved ones do die, they are dead. They are not in heaven. Nor are they in hell fire or anywhere in between.
"For the living know that they shall die: but the dead know not any thing..." (Ecclesiastes 9:5).
Those who are dead "know not anything" says the Word of God. Think about that. How can the dead speak when they don't know any thing? Exactly, it is not them who speak. It is Satan and his demons personating dead loved ones appearing as and speaking like them.
"And no marvel; for Satan himself is transformed into an angel of light." (2 Corinthians 11:14).
"But man dies, and wastes away: yea, man gives up the ghost, and where is he? As the waters fail from the sea, and the flood decays and dries up: So man lies down, and rises not: till the heavens be no more, they shall not awake, nor be raised out of their sleep. O that You would hide me in the grave, that You would keep me secret, until Your wrath be past, that You would appoint me a set time, and remember me! If a man dies, shall he live again? all the days of my appointed time will I wait, till my change comes." (Job 14:10-14).

So when then do our loved ones who accepted Jesus Christ as their personal Savior go to heaven? The answer is: At Jesus Christ's Second Coming.
"For the Lord himself shall descend from heaven with a shout, with the voice of the archangel, and with the trump of God: and the dead in Christ shall rise first: Then we which are alive and remain shall be caught up together with them in the clouds, to meet the Lord in the air: and so shall we ever be with the Lord. Wherefore comfort one another with these words." (1 Thessalonians 4:16-18).
Here we find one reason why God became Man, the Man Jesus Christ, and died in humanity's stead: to atone (to make right or to make reconciliation) for the guilt of their transgression of the Law of Love - the Ten Commandments. Thus, the resurrection from death (from not existing) unto eternal life is made possible to all who accept Him, Jesus Christ (the Messiah), as their personal Savior, accepting that He died in their stead because of their transgressions - a Ransom payment you can say. His life for yours. He takes your sin on Him and offers you His spotless Righteousness - if you will only take it.
All we need to do, is to look at the Cross in faith, confess our transgressions of our Creator's Ten Commandments and take hold of His grace and His Righteousness to walk in a new slate of life - a life of loving Jesus our Creator and obeying His Law of love, His Ten Commandments.
"For this is the love of God, that we keep His Commandments: and His Commandments are not grievous." (1 John 5:3).

WHAT HAPPENS TO A PERSON’S ESTATE WHEN HE OR SHE DIES?
"A
deceased estate comes into existence when a person dies leaving
property or a document which is a will or purports to be a will. Such
estate must then be administered and distributed in terms of the
deceased's will or failing a valid will, in terms of the Intestate
Succession Act, 81 of 1987. The procedure which must be followed to
administer a deceased estate is prescribed by the Administration of
Estates Act, 66 of 1965 (as amended)." The Master of the High
Court
“At
death the estate of the deceased person is frozen, and no-one may
withdraw funds from the deceased’s bank accounts or deal with any
of the estate assets without the necessary permission from the Master
of the High Court. If the deceased was married in community of
property, the joint estate is frozen. This situation often creates
hardship for the surviving spouse, especially where the bank accounts
were all in the name of the joint estate or in the name of the
deceased.” The Master of the High Court
HOW CAN WE HELP?

Upon the death of a person, the estate must be reported by an interested party to Master’s Office in which jurisdiction the deceased normally lived, within 14 days.
The reporting documents will differ slightly depending on the value of the estate and the type of appointment required.
If the value of the estate exceeds R250 000, letters of executorship must be issued and the full process prescribed by the Administration of Estates Act must be followed.
However, if the value of the estate is less than R250 000, the Master of the High Court may dispense with letters of executorship and issue letters of authority in terms of Section 18(3) of the Administration of Estates Act, (Act 66 of 1965).
The Magistrates’ Office service points will only have jurisdiction if the deceased did not leave a valid will and the gross value of the estate is less than R125 000 where there is no PEAS (Paperless Estates Administration System).
Letters of authority entitle the nominated representative to administer the estate without following the full procedure set out in the Administration of Estates Act.
We can act as the Executor of your loved one's estate and administer the whole process from the start to the end. If we are appointed, we will:
- Fill in and submit all the required forms to the Master of the High Court
- Assist with obtaining valuations where required
- Open an estate bank account (if needed)
- Place the required advertisements in the newspaper and the Government Gazette
- Prepare the liquidation and distribution account
- Initiate the process of the submission of any tax returns which are to be submitted
- Initiate the transfer of fixed property (if any)
- Facilitate the payment of creditors and beneficiaries
- Attend to any queries which the Master of the High Court may raise
- Perform further actions as required
